Agreement for Romney's Rannells Airport, 1940

In 1940 the Town of Romney began an effort to establish an airport for the area. This Agreement between the Town and J. Holland Rannells lays out the way the airport will be established and maintained. Unfortunately, World War II intervened, and we do not know what became of the effort. The agreement may never have been signed. We would appreciate information from anyone who knows.


 

THIS AGREEMENT, made and entered into this ___ day of July, 1940, by and between J. Holland Rannells, party of the first part, and The Town of Romney, West Virginia, a municipal corporation, party of the second part.

WHEREAS, the said J. Holland Rannells for a number of years past has been operating a private airport on the farm belonging to Richard Kuykendall Heirs situated about three miles North of The Town of Romney, West Virginia, on the east side of State Route No. 28, on a field containing about twenty acres, more or less.

WHEREAS, on the ___ day of July, 1940, the said J. Holland Rannells entered into a lease agreement with Richard Kuykendall, to renew and continue his lease of the said premises for a term of ten years for the “purposes consistent therewith” a copy of which agreement is herewith attached to this writing and reference is here made for the purpose of setting forth the description of the property, terms, conditions, and facts of said lease agreement, and

WHEREAS, the said J. Holland Rannells and the said Town of Romney, a municipal corporation, are now engaged in negotiations with the proper authorities of the State Road Commission as well as other state and governmental agencies for the purpose of seeking their aid in a project for the construction, improvement, and maintenance of the above property as a proper and satisfactory field for aviation purposes, and

WHEREAS, in order to secure the aid of these governmental agencies, it is necessary that such a project be sponsored by a pubic or governmental body, and

WHEREAS, The Town of Romney, a municipal corporation, realizing the many benefits that will be derived from the construction and operation of an airport in close vicinity to the corporate limits of the said municipal corporation has agreed with the said party of the second part to act as sponsor of such a project for the purposes of constructing such an airport on the property hereinabove set forth.

NOW, THEREFORE, THIS AGREEMENT, WITNESSETH: that for and in consideration of the said J. Holland Rannells granting unto the mayor, town council, officers, employees, and agents of The Town of Romney, a municipal corporation, during the term of this lease, all rights and privileges of using the said airport while in the exercise and performance of their official duties for the municipality, the said Town of Romney agrees to act as sponsor of any project for the construction, improvement, equipping, maintenance, and operation of the said field for aviation purposes.

It being mutually agreed that the said Town of Romney, a municipal corporation, shall in no way be peculiarly responsible for the construction, operation, or maintenance of said airport nor shall the said Town of Romney, a municipal corporation, be liable to any person for loss or damage suffered during the term of this agreement on account of the condition of the airport or for any reason whatsoever.

It being further mutually agreed that the said J. Holland Rannells, his personal representative or assigns, shall be responsible for the securing in any way he may see fit, any contribution as the sponsor's share of the expense that may be necessary to receive the aid of any of the governmental agencies in the construction, improvement, and maintenance of said field as an airport for aviation purposes.

It being further mutually agreed that the said J. Holland Rannells, his personal representatives and assigns, shall have the exclusive rights to the supervision, management, and operation of said airport including the right to any or all concessions and benefits of a private airport consistent with the rights and privileges of the said Town of Romney, a municipal corporation, hereinabove set forth.

It being further mutually agreed that the said J. Holland Rannells, his personal representatives and assigns, shall not be liable to the said Town of Romney or any other person for loss or suffered during the term of this agreement on account of the condition of the “airport” or by livestock that may thereon under terms of the lease agreement with Richard Kuykendall.

It being further mutually agreed that the said field shall be known as “The Romney Airport.”

IN WITNESS WHEREOF, the said J. Holland Rannells has this day signed this agreement in his own right and The Town of Romney, a municipal corporation, has caused this agreement to be executed in its name and behalf by its mayor and its corporate seal to be hereunto affixed under the authority and approval of the Council of said town the day and date first above written.
